Accepting these terms

These terms apply between you and Optixfusion ("we", "us"). By using this website, approving a proposal or paying for our services, you agree to them. If you are accepting on behalf of a company, you confirm that you have the authority to do so.

If a signed proposal or agreement says something different from these terms, the proposal or agreement applies.

Our services

We provide website development, Shopify store development, Shopify SEO and advertising services. The exact work, deliverables and timeline for your project are set out in your written proposal. Anything not listed there is outside the agreed scope, and we will quote for it separately.

Quotes, prices and payment

• Prices on our website are in US dollars and do not include taxes, unless stated otherwise. They are a starting guide, and your proposal confirms the final price.
• Your proposal sets out when each payment is due. We may pause work if a payment is overdue, and timelines may move as a result.
• Monthly plans continue until they are cancelled, and may have a minimum term shown on the service page or in your proposal.
• Our Refund Policy explains how cancellations and refunds work.

Your responsibilities

To keep your project on track, you agree to:

• Give us accurate information, along with the content, access and approvals we need, on time.
• Make sure you have the rights to any text, images, logos and other materials you give us.
• Make sure your products, store and advertising follow the laws and platform rules that apply to you.
• Keep your own account passwords secure and share access with us through safe methods.

Revisions, timelines and go-live

Your package or proposal states how many revision rounds are included. Further revisions or new requests may be charged separately.

Timelines are our best estimates and depend on receiving your content, access and feedback on time. If a project stays on hold because we are waiting on you, we may reschedule it around our other work, and restarting it may involve extra charges. We will tell you first.

Before launch, we will ask you to review the work. You are responsible for approving it before it goes live.

Third-party services and costs

Our work often relies on third-party services such as Shopify, hosting providers, apps, payment gateways and ad platforms. These have their own terms, prices and availability, and we do not control them. Unless your proposal says otherwise, you pay these costs separately, and ad spend is paid directly to the ad platform.

We are not responsible for losses caused by outages, policy changes, account suspensions or price changes made by third parties.

Affiliate links

Some links on this website, including Shopify offers, are affiliate links. If you sign up or buy through one, we may earn a commission at no extra cost to you. Offers and their terms are set by the provider and may change at any time.

Ownership of work

• Once you have paid in full, you own the final work we created specifically for you.
• Third-party items, such as themes, apps, fonts and stock images, stay under their own licences.
• We keep ownership of our general tools, methods and know-how, and of any reusable code we had before your project.
• You keep ownership of everything you give us. You allow us to use it only as needed to do the work.
• We may show completed work in our portfolio and marketing. Please tell us in writing if you would prefer that we did not.

No guarantee of results

Search rankings, traffic, ad performance and sales depend on many things outside our control, including search engines, ad platforms, competitors, your products and your market. We use our experience and care in everything we do, but we cannot promise specific results unless your proposal says so in writing.

Using this website

The content on this website, including text, design, logos and images, belongs to Optixfusion or its licensors. You may read and share it for personal or internal business use, but you may not copy, resell or republish it without our written permission.

You also agree not to misuse the site, for example by trying to break its security, sending spam through its forms or interfering with how it works. Blog articles and other website content are for general information and are not professional advice for your specific situation.

Links to other websites

Our website links to other websites. We do not control them, and we are not responsible for their content, offers or privacy practices. Please review their own terms before using them.

Confidentiality

Each of us agrees to keep the other's private business information confidential and to use it only for the project, unless the law requires us to share it or the information is already public.

Limit of liability

As far as the law allows, we are not liable for indirect losses, such as lost profits, lost sales, lost data or damage to reputation. Our total liability for any claim relating to a service is limited to the fees you paid us for that service in the 3 months before the claim arose. Nothing in these terms limits any liability that cannot legally be limited.

Ending our work together

Either of us may end a project in writing if the other seriously breaches these terms and does not fix the problem within 14 days of being told about it. You may also cancel as described in our Refund Policy. When work ends, you remain responsible for paying for work completed up to that date.

Governing law and disputes

These terms are governed by the laws of India. If a problem comes up, please contact us first so that we can try to resolve it together. Any dispute we cannot resolve will be handled by the competent courts in India.

Changes to these terms

We may update these terms from time to time and will change the date at the top of this page when we do. The version in place when you approved your proposal continues to apply to that project, unless we both agree otherwise.
